  SHERIFF KIRKLAND CONFIRMS ARRESTS

We received the following confirmation from Sheriff Dick Kirkland of Washoe County, NV

January 13, 1999

I can confirm our arrests as reported. We have arrested two Marines, one each in 29 Palms and Pendleton and one local resident. We have forensic evidence plus witness information and certain confessions that led us to make these arrests. We are extradicting the two Marines and we have the one local resident in custody. We are continuing to investigate and there may be more developements...however for now this case is solved and will be turned over to the District Attorney. We feel confident about a successful prosecution. The credit goes to the detectives, men and women, who worked tirelessly on this case and who were responsible for breaking down the suspects and obtaining a confession.....thank you for your support.

Our congratulations go out to the Washoe and Storey County Sheriff's Departments, as well as to all the other state and federal personnel who participated and assisted in this investigation, for a job well done!

All three suspects were from the Reno area; one being a 20 year old local construction who was reported to have a string of hunting violations, and two being Marines based in California who were home in Reno for the holidays. The construction worker is out on $60,000.00 bond and the two Marines are being extradited.

The following message was forwarded from the Nevada State Attorney General's Office:

    I am a deputy attorney general in the Conservation and Natural
Resources section and counsel to the Nevada Commission for the 
Preservation of Wild Horses.  Frankie Sue referred your e-mail to me 
for response.

    We at this office are as shocked and disturbed as you are about this
terrible and senseless act of cruelty.  Though the Storey County law
enforcement team and District Attorney are primarily responsible for the
investigation and prosecution, a number of state agencies have pitched in
to help in every possible way.  The state has additional interest, as well,
because the horses did not live on federal land, where the United States
Bureau of Land Management has jurisdiction.  These Virginia Range horses
are managed by the state and by law are considered to be the state's
responsibility and property. In addition, the Nevada Commission for the
Preservation of Wild Horses helped coordinate efforts to put up reward
money for bringing the killers to justice and contributed to the reward
fund, which is now about $35,000.  A large number of animal groups and
private citizens, both from Nevada and other states, contributed time, 
work and money and are very involved in this issue as well. 

    As you are probably aware, three suspects have been apprehended, all
young men in their early twenties, two of whom are U.S. Marines. If
convicted, they could face a 2 to 5 year prison sentence for each horse
killed.  Clearly, no one here in Nevada is taking this lightly. 

    Thank you again for your letter.  Please do not hesitate to contact us

  POSSIBLE PLEA BARGAIN?

I have not been able to confirm the following message but it might not hurt to send some letters just in case. Thanks to Pat Fredrickson for passing this along to me.

Hi everyone,

I am sending this to save time. I talked with Kathy Barcomb the executive secretary for the Wild Horse commission yesterday and she says that Storey County will probably plea bargain the jerks that killed all the wild horses because of lack of funds for such a high profile case.... So we want the State to prosecute. If there is enough outrage of the issue, they will probably take it. Frankie Sue Del Papa (Nevada State Attorney General), is chopping at the bit to prosecute this one, but the order has to come from higher up.

  UPDATE!!!

The Office of the Nevada State Attorney General has sent an explanation as to what is happening with the prosecution. This information appears on Page 3 of this information series.
